Exclusive Remedy

Exclusive remedy describes the only recourse a plaintiff has. Often used in workers compensation insurance policies, it indicates that the employee cannot sue their employer if they are collecting workers compensation benefits. The benefits under the workers compensation policy are the exclusive remedy for their illness or injury.
