Professional Liability

An employment agency is retained by two companies who are competitors. The agency places an employee of one of the companies in a position at the other company. The first client sues the agency for interference with contractual relations and potential competitive damage for placing their employee with a competing company. 

 

A staffing agency places a programmer with a software company for what is supposed to be a six-month contract. The project is not complete when the contract ends and the software company wants to extend it. The programmer’s visa will expire shortly and he has to go back to his home country. The staffing agency did not disclose the visa expiration when the programmer was hired, and the software company sues the agency.
