- New: Exclusion – Communicable Disease (CG 21 32): Precludes coverage for bodily injury, property damage, and personal and advertising injury based upon or arising out of any actual or alleged transmission of a communicable disease.

1. When would the communicable disease exclusion (CG 21 32) apply?

- This exclusion is applicable whenever there is a claim alleging the actual or alleged transmission of a communicable disease resulting in property damage, bodily injury, or personal and advertising injury. This exclusion also applies even if the claim against the insured alleges negligence or other wrongdoing in the:
- Supervising, hiring, employing, training or monitoring of other that may be infected with and spread a communicable disease,
- Testing for a communicable disease,
- Failure to prevent the spread of the disease, or
- Failure to report the disease to authorities.

2. Are the endorsements for new policies and renewals?
Yes. Existing customers will receive a ‘conditional renewal’ notice in accordance with their respective state’s statutes or Department of Insurance rules.
3. Will existing customers and their agents or brokers (if applicable) receive an email notification?
Renewal policy documents will contain a cover letter highlighting the new endorsement. They are emailed approximately 45 days before renewal.
4. Is there any ‘buy back’ option or underwriting exception to remove the endorsement?
Not at this time. Hiscox made the decision to change the policy’s terms and conditions rather than increase premium, so there is no option to remove the endorsement.

6. When is the change effective?
All new business effective January 23, 2023 and later will have the new endorsement attached automatically. Renewals with May 20, 2023 effective dates and later will automatically have the new endorsement attached.
Yes. Quotes that are retrieved and bound after the implementation date will include the new endorsement.
